Writ of Replevin Procedure

1) Obtain a valid Writ of Replevin from Dane County Circuit Court

Make sure the Writ of Replevin contains the following:

  • Correct court case number
  • Correct spelling of Plaintiff and Defendant names
  • Complete address of Defendant (inc. apt/unit number)
  • Dane County Court seal
  • Electronic signature of a court official
  • Description of property to be returned to Plaintiff (must include a VIN, serial number or other owner applied number if applicable and a specific description of the property (i.e. color, identifying markings or other characteristics)
     

 

It is the Plaintiff’s responsibility to make sure all information is correct prior to submitting the paperwork to the Dane County Sheriff’s Office

*DO NOT ALTER THE ORIGINAL COURT DOCUMENT. THE DANE COUNTY SHERIFF’S OFFICE WILL NOT ACCEPT DOCUMENTS WITH ANY ALTERATIONS.

2) A Writ of Replevin is only valid for a limited time.  Once received, the Sheriff has 60 days to execute the Replevin.

3) A bond of indemnity may be required if the Sheriff determines there is doubt of ownership.  This will be evaluated on a case by case basis by deputies.

4) When submitting the Writ of Replevin, the Plaintiff must provide an address and phone number for contact and billing purposes, along with any information to assist the deputies in recovering the property.  Writs may be delivered to the Dane County Sheriff’s Office by either:

  • Submitting all paperwork at the Sheriff’s Office Civil Process window located on the 2nd floor of the Public Safety Building, Monday through Friday between 8 a.m. and 4 p.m. OR
  • Submitting all paperwork electronically via cprocess@danesheriff.com
     

Sheriff's Office Fees

  1. Writ of Replevin submitted but no property is seized/returned to plaintiff $40
  2. Writ of Replevin submitted and property is seized/returned to plaintiff
  • $40 service fee + 1 round trip mileage + plus 1 hour minimum standby fee; and
  • 1 deputy - $73.66 per hour
  • Additional deputies as needed - $73.66 per added deputy
  • If a tow company is required, the Plaintiff shall be responsible for the payment of the tow company fees

Pre-payment of Sheriff's fees is required for all accounts with past due balances
